§ 1 Scope
The following conditions apply to the use of the forum (https://forum.gta5cloud.com/) provided by CloudRoleplay (hereinafter referred to as the "Provider").
Use of the forum is only permitted if you, as the user, accept these terms of use. If you do not agree with these conditions or any part of them, you are strongly urged to immediately cease using this forum. We assume no liability for your use of this forum or access to any part thereof.
§ 2 Registration, Conclusion of Contract, and Object of Contract
1. The prerequisite for using the forum is registration via the corresponding online form. After registering via the online form in the forum, you will receive a confirmation email to verify your data, which you can confirm by mouse click. Upon activation of your account by the provider, the free forum usage agreement (conclusion of contract) is established.
2. The object of the contract is the free use of the forum's functions as an online communication platform. As a user, you will be provided with an "account" through which you can post contributions and topics in the forum.
3. There is no basic entitlement to activation or participation in the forum. The operator's unrestricted right of domicile applies.
4. Your forum account may only be used by you. As the account holder, you are also responsible for protecting it against misuse. Therefore, your access data must be protected from third-party access. It shall at all times remain your responsibility to protect and keep your username and password with utmost confidentiality and security. Any breach of your username and password information shall not be attributable to use and in any case we shall not accept any liability. The use of trademark-protected words and internet addresses as a username (nickname) is not permitted.
5. The provider will strive to offer the service for retrieval as uninterrupted as possible. Even with all due care, downtimes cannot be ruled out during which the web servers are not accessible via the internet due to technical or other problems that are not within the provider's sphere of influence (third-party fault, force majeure, attacks on the infrastructure by hackers, etc.). The user acknowledges that a 100% availability of the website is not technically feasible.
6. The provider reserves the right to change and expand the content and structure of the platform as well as the associated user interfaces if this does not or only insignificantly affects the fulfillment of the contract concluded with the user. The provider will inform the users accordingly about the changes.
7. This forum is established as a platform for the exchange of diverse opinions and ideas, constituting a virtual marketplace of thoughts intended for public discourse. The primary aim is to foster a harmonious and respectful environment where users can engage in constructive dialogue without resorting to disparagement or hostility.
§ 3 Duties as a Forum User
1. As a user, you undertake not to publish contributions that violate these rules, good manners, or otherwise violate applicable German law. In particular, you are prohibited from:
2. As a user, you undertake to check your contributions and topics before publication to ensure that they do not contain information that you do not wish to publish. Your contributions and topics can be indexed by search engines and thus become globally accessible. There is no entitlement to the deletion or correction of such search engine entries against the provider.
3. In case of violation, especially of the aforementioned rules § 3 para. 1 and 2, the provider may impose the following sanctions against the user, independently of termination:

If third parties or other users hold the provider liable for possible legal violations resulting a) from the content you as a user have posted and/or b) from your use of the provider's services, you as a user undertake to indemnify the provider against any claims, including claims for damages, and to reimburse the provider for the costs arising from the potential legal infringement. In particular, the provider shall be exempt from the costs of necessary legal defense. The provider is entitled to demand a reasonable advance payment from you as a user for this purpose. As a user, you are obliged to support the provider in good faith with information and documents in the defense against third parties. All further rights and claims for damages of the provider remain unaffected. If, as a user, you are not responsible for the possible legal infringement, the aforementioned obligations do not exist.
§ 4 Transfer of Usage Rights
1. The copyright for your topics and contributions, insofar as they are protectable by copyright, generally remains with you as a user. However, by posting a topic or contribution, you grant the provider the right to permanently retain the topic or contribution on its websites. Furthermore, the provider has the right to delete, edit, move, or close your topics and contributions.
2. The aforementioned usage rights also remain in force in the event of termination of the forum account.
§ 5 Limitation of Liability
In no event shall the Provider be liable to the Client for any indirect, special, consequential, incidental, punitive, or exemplary damages, including but not limited to, loss of profits, loss of business, loss of data, or any other loss arising out of or in connection with the services provided under this Agreement, regardless of the form of action, whether in contract, tort (including negligence), or otherwise.
§ 6 Duration / Termination of the Contract
1. This agreement is concluded for an indefinite period.
2. Both parties can terminate this agreement without observing a notice period.
3. In the context of terminating the user relationship by deleting the user account or terminating the associated contract, the user's public statements, especially in the form of forum posts, remain publicly accessible. The corresponding user account becomes inactive and is identified as "Guest" in the forum. All other personal data of the user undergoes complete deletion.
It should be noted that in the case of an explicit request from the user regarding the elimination of their public posts, this must be expressly communicated to the provider as part of the deletion request. However, it should be noted that due to legal regulations, especially considering the General Data Protection Regulation (GDPR), unrestricted removal of public posts may not be legally enforceable.
